Abstract :

The concept of digital arrest is an emerging issue at the intersection of cybersecurity, law enforcement, and human rights. It refers to the restriction of an individual’s online presence, access to digital services, or use of electronic devices as a form of legal enforcement or punitive action. Governments and law enforcement agencies increasingly use digital tools to monitor, detain, or control individuals in cyberspace. While digital arrests can aid in crime prevention and national security, they raise significant concerns about privacy, freedom of expression, and due process. This paper examines case studies and legal frameworks to understand the implications of digital arrest across different jurisdictions. Solutions such as stronger digital rights protections, legal safeguards, and international regulatory cooperation are necessary to prevent abuse. By balancing security needs with civil liberties, societies can develop fair and transparent digital enforcement mechanisms. Every sovereign nation's infrastructure is very important and includes the criminal justice system. The main purpose of it is to keep people safe, but it also aids in the detection of illegal behavior. [DR.
